Terms of Service

These Terms of Service ("Terms") form a binding agreement between you ("Customer," "you") and My Bid Boss ("My Bid Boss," "we," "us") governing your access to and use of the My Bid Boss web application, websites, and related services (collectively, the "Service"). By creating an account, subscribing, or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.

My Bid Boss is subscription-based estimating software that helps residential and commercial cleaning companies generate professional bids and pricing proposals. The Service is provided "as is" as an informational tool; final pricing, contracts, and job execution remain your responsibility.

You must provide accurate registration information and keep your credentials confidential. You are responsible for all activity under your account. You must be at least 18 years old and authorized to bind the business you represent.

Paid plans are billed in advance on a recurring basis (monthly or annually) at the rate disclosed at checkout. Fees are processed by our third-party payment provider. Unless required by law or expressly stated in our Refund & Cancellation Policy, all fees are non-refundable. You authorize us to charge your payment method for each renewal until you cancel.

You may cancel your subscription at any time from your billing settings. Cancellations take effect at the end of the current billing period. See our Refund & Cancellation Policy for details.

You agree not to:

• use the Service for any unlawful, misleading, or fraudulent purpose;
• reverse engineer, resell, or sublicense the Service;
• upload malicious code or attempt to disrupt the Service;
• use the Service to send unsolicited communications; or
• infringe the intellectual property or privacy rights of others.

You retain ownership of the data you submit (customer information, pricing settings, estimates). You grant My Bid Boss a limited license to host, process, and display that data solely to operate and improve the Service. You are responsible for having the rights to submit customer information and for complying with applicable privacy laws.

The Service, including its software, design, branding, and content (excluding your data), is owned by My Bid Boss and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable right to use the Service in accordance with these Terms.

The Service integrates with third-party providers (for example, payment processing and cloud infrastructure). Your use of those services is governed by their own terms. We are not responsible for third-party outages or actions.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. Estimate outputs are suggestions based on the inputs you provide; you are solely responsible for the prices you quote to your customers.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MY BID BOSS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUE, WHETHER INCURRED DIRECTLY OR INDIRECTLY. OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS OR THE SERVICE WILL NOT EXCEED THE AMOUNTS PAID BY YOU TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

You agree to indemnify and hold harmless My Bid Boss from any claim or demand arising out of your use of the Service, your data, or your violation of these Terms.

We may suspend or terminate your access if you violate these Terms or if required by law. On termination, your right to use the Service ends immediately. Sections that by their nature should survive termination will do so.

We may modify the Service or these Terms from time to time. Material changes will be communicated by email or in-app notice. Continued use after changes take effect constitutes acceptance.

These Terms are governed by the laws of the United States and the state in which My Bid Boss is organized, without regard to conflict-of-laws principles. Disputes will be resolved in the courts of that jurisdiction unless otherwise required by law.
